When communications are directly linked to an existing business relationship, they may be carried out when there is a legally applicable legal basis.

When it is necessary to obtain consent for certain commercial communications, it will be requested specifically.

The fact that a person appears as a professional contact for a company does not automatically imply that their professional address may be used for any advertising purpose.

When processing is based on the legitimate interest provided for certain professional contact data, the purpose must remain linked to the relationship with the corresponding legal entity. The AEPD explicitly states that this basis does not allow the use of professional data to direct advertising to the individual in a private capacity. (AEPD)

Electronic commercial communications will also comply with applicable regulations regarding information society services and commercial communications.

Where appropriate, commercial communications will include adequate mechanisms to stop receiving such communications.

  • Manage communications.

  • Maintain information related to business relationships.

  • Manage certain interactions with customers and professional contacts.

Data used exclusively to manage a professional request will be kept for the time necessary to address it and, subsequently, for the period necessary to verify the proper management of the request when appropriate.

Data used for commercial communications will be kept as long as there is a legal basis that allows their use and as long as their deletion or opposition is not requested, where applicable.

When processing is based on consent, data will be kept as long as such consent is not withdrawn, without prejudice to those processing activities that may be maintained on another legal basis.

Once the corresponding periods have ended, the data will be deleted or, where appropriate, blocked during the legally established periods.

15. DATA OF SOLE PROPRIETORS AND PROFESSIONALS

When the relationship is established with a sole proprietor or self-employed professional, UNIKA LIVING may process the data necessary to manage the professional relationship.

The LOPDGDD provides for a presumption of legitimate interest for certain data processing activities concerning individual entrepreneurs and self-employed professionals when referring to them exclusively in that capacity and not used to establish a relationship with them as natural persons. (BOE)

Therefore, UNIKA LIVING shall limit the processing to the relevant professional sphere and shall refrain from using such data for purposes unrelated to said professional relationship.

16. DATA OF REPRESENTATIVES AND CONTACT PERSONS

When a person acts as a representative or contact person for a company, UNIKA LIVING may process the professional data necessary to maintain the relationship with said company.

  • Locate them professionally.

  • Manage the relationship with the company.

  • Manage requests, operations, and incidents.

  • Maintain the communications necessary for the professional relationship.

It will not be necessary to request private personal data when adequate professional data can be used for the corresponding purpose.

In general, the response period will be one month, without prejudice to any possible legally provided extensions.

20. WITHDRAWAL OF CONSENT AND OBJECTION
